General Terms and Conditions of Sale

These general terms and conditions must be read carefully before ordering any of our creations.

Payments

Payment for products, shipping and delivery costs, as well as any applicable taxes, must be made by debit card, credit card, or bank transfer.

Payment is due at the time of order placement and acceptance of the offer made by Charles-Emmanuel Deppierraz.

Prices

Unless otherwise stated, our prices are quoted in Swiss Francs.

Taxes

For deliveries within Switzerland or the EU, the local VAT rate will be applied.

For deliveries outside Switzerland or the EU, VAT will not be applied. However, import duties and/or taxes in accordance with the national laws of the destination country may be levied.

Unfortunately, we cannot predict these costs.

The buyer is responsible for settling all import charges associated with the chosen country.

Order Processing

We will process your order as quickly as possible upon receipt of payment.

Payments may be subject to validation checks, and Charles-Emmanuel Deppierraz reserves the right to delay an order if additional security checks are deemed necessary.

Once your order is dispatched, we will send you the package tracking number by email.

For security reasons and generally due to package size, we do not deliver to post office boxes.

Buyer’s Responsibilities

Before ordering any of our creations, it is the sole responsibility of the buyer to ensure and determine whether they can receive the ordered products. This includes ensuring that the ordered products can fit into the house or building for which they are intended, as well as through the apartment door, room entrance, stairwells, or any other areas that might compromise or prevent delivery.

Shipping Costs and Crating

Shipping costs and custom crating will be added to the price based on the destination and package volume.

Charles-Emmanuel Deppierraz arranges order shipments via carriers specializing in the delivery of furniture and artworks.

If the client chooses to manage their own freight and delivery, Charles-Emmanuel Deppierraz must be informed of the specific details of the operation.

The pickup location by the client or the client’s agent may trigger sales tax liability at that location.

Product ownership is transferred to the client (owner) via the carrier upon their taking possession of the transport order. Consequently, responsibility for damages occurring in transit lies with the owner, and all claims for freight damages must be made within 72 hours of receipt.

If the client chooses their own carrier, freight claims must be filed directly with the selected carrier. Charles-Emmanuel Deppierraz is not responsible for damages to client or third-party freight, nor for the claim itself.

Product Receipt

Charles-Emmanuel Deppierraz recommends using a qualified receiving warehouse to receive, inspect, and validate deliveries, thereby facilitating home installation. All crated goods must pass through a professional receiver such as a receiving warehouse.

A receiving warehouse acts as an agent for the client and is responsible for noting any damage and assisting the owner in filing a freight claim when damage is identified.

A qualified receiving person must be present to accept products when they are delivered directly.

A signature on the delivery note (BDL) at the owner’s premises upon product receipt confirms that the products were received in good condition, unless otherwise indicated on the BDL.

If merchandise is refused upon delivery due to quality issues or damage, the receiver must immediately contact Charles-Emmanuel Deppierraz.

Full inspection must take place within 48 hours of delivery, and all freight claims must be filed within 72 hours.

Product Inspection

Carefully inspect cartons or crates. If necessary, take photos of any packaging damage to facilitate the quickest resolution of damage claims.

Inspect the branded tape seal. If it is not intact or is covered, you should presume the package has been opened. Indicate this on the BDL.

Unpack cartons or crates. Carefully inspect all merchandise. Cartons and crates should always be unpacked in your presence.

It is advisable never to discard the original packaging until delivery is deemed satisfactory.

Product Quality and Reporting Transit Damage.

Products are inspected by Charles-Emmanuel Deppierraz or its suppliers before release to ensure that the order is in good condition, complete, and ready for shipment.

The carrier is responsible for a full inspection of products at the point of origin. Any damage must be noted on the BDL.

The signed BDL is the carrier’s confirmation that they have accepted responsibility for delivering the products in the condition in which they were received.

If the inspection of packaged products is limited to the exterior of the packaging, exceptions must be noted. Packaging should be opened immediately if the condition of the cartons or crates appears compromised.

It is recommended to entrust the assembly, installation, and maintenance of our creations to professionals.

Made-to-Order Items

With exceptions, our creations are offered on a made-to-order basis. An estimated delivery time is indicated for each item and will be confirmed upon order placement.

We strive to provide the most accurate delivery date possible. Nevertheless, the production of our creations may be delayed due to unforeseen circumstances beyond our control (supplier delays, carrier delays, natural disasters, etc.).

Product Images and Sizes

Product images displayed on www.charlesdeppierraz.com are for illustrative purposes only. While we have made every effort to display colors accurately, we cannot guarantee that your computer will display colors precisely or reflect the product colors.

The products delivered to you may vary slightly from the images.

Furthermore, many wood, stone, and metal finishes are handcrafted and may vary in color, tone, and patina.

Charles-Emmanuel Deppierraz will make every effort to match a finish; however, no guarantee can be made for an exact match. It does not guarantee the finish against fading and oxidation.

Variations in color and texture are inherent to stone, wood, and metal. They are considered part of the object’s natural beauty.

Furniture and lighting fixtures created by Charles-Emmanuel Deppierraz are handcrafted and are therefore subject to slight variations.

Charles-Emmanuel Deppierraz does not guarantee against the fading of dyed and natural fabrics.

While we have strived to be as accurate as possible, the measurements provided, including indicated weights and dimensions, are approximate.

All designs, descriptions, weights, dimensions, and illustrations are approximate and are intended to provide a general description of the products and do not form part of this agreement.

No dispute or refusal of merchandise will be accepted in relation to this matter.

Jurisdiction and Applicable Law

In the event of a dispute, Swiss courts shall have exclusive jurisdiction, notwithstanding any third-party claims or multiple defendants, and notwithstanding any contrary provision printed in buyers’ purchase orders. However, Charles-Emmanuel Deppierraz reserves the right to bring proceedings before the competent courts of the buyer’s domicile. The applicable law shall be Swiss law.
